    The Rule Change Explained

    What the March 2026 OIA Changes Mean for AIP Visa Holders

    Before 6 March 2026, most Active Investor Plus Visa holders were unable to purchase residential property in New Zealand without first meeting an ordinary residency threshold, typically requiring at least 12 months of physical presence in the country.

    The 2025 amendments to the Overseas Investment Act changed this. AIP visa holders, along with holders of the legacy Investor 1 and Investor 2 resident visas, can now apply for consent to purchase or build one qualifying residential property in New Zealand, subject to the following conditions:

    • The property must be valued at NZ$5 million or more (combined land and build cost for new builds)
    • The land must be classified as residential or lifestyle on the district valuation roll
    • The land must not be otherwise sensitive (certain coastal, island, and large rural parcels are excluded)
    • OIO consent must be obtained before signing any sale and purchase agreement
    • Only one property may be owned under this pathway at any time

    The OIO consent process has been streamlined to a 5-business-day fast-track for qualifying applications, but the pre-consent due diligence is where buyers are most exposed without independent representation.

    The AIP property pathway sits at the intersection of immigration law, property law, and market execution. Your immigration adviser manages the visa side. Your NZ lawyer manages the legal and OIO consent side.     Do I need OIO consent before making an offer on a property?

    Yes. Under the Overseas Investment Act, AIP visa holders must obtain OIO consent before signing a sale and purchase agreement. The exception is auction, where a conditional bid arrangement must be negotiated with the vendor before the auction date. Consent cannot be granted in anticipation of an auction without an agreed purchase price. Your NZ lawyer manages the consent application; a buyers agent coordinates the process and timeline around it.

    What types of property qualify under the AIP visa pathway?

    The property must be classified as residential or lifestyle land on the district valuation roll and must not be otherwise sensitive under the Overseas Investment Act. Sensitive exclusions include certain coastal land, islands, and non-urban land over 5 hectares. The property value (or combined land and build cost for new builds) must exceed NZ$5 million. Sensitive land classification should always be confirmed on the title before proceeding, this is one of the most common due diligence gaps for buyers without independent representation.

    Can I buy at auction as an AIP visa holder?

    Yes, but with conditions. OIO consent cannot be granted until there is an agreed purchase price, which means standard pre-consent before an auction is not possible. To participate in an auction, a conditional bid arrangement must be negotiated with the vendor prior to the auction. This requires early engagement with the selling agent and coordination with your lawyer. Alistair manages this process for buyers he represents.

    Does the property purchase count toward my AIP visa investment requirements?

    No. A residential property purchased under the AIP investor-home pathway does not count toward the qualifying investment requirements of the visa (NZ$5M in the Growth category or NZ$10M in the Balanced category). The property purchase and the visa investment are entirely separate. This is one of the most important points for capital allocation planning.

    Can I purchase through a trust or company structure?

    Potentially, subject to restrictions. The OIO consent conditions and the Overseas Investment Act impose requirements on ownership structures. Your NZ lawyer and tax adviser need to assess the appropriate structure before purchase.
